Limits to Organizing
What can/can’t you do in an organizing campaign?
U.S. Labor laws outline illegal behaviors for both employers and unions during an organizing campaign. In simplest terms, it is illegal to spy, coerce, threaten, punish, or otherwise intimidate employees to vote one way or another. In addition, it is illegal to offer inducements or bribes to try to buy votes. Some illegal behaviors might not be what you expect. For example, it is generally illegal for employers to pull employees aside and ask them whether they plan to vote for union representation as this can be intimidating to employees. Similarly, it would be illegal for an employer to raise wages or start providing new benefits in response to worker interest in unionizing.
